Welcome to Market It! (the "App"), a mobile application owned and operated by Lucrative Software Solutions ("Company," "we," "us," or "our").

By downloading, installing, creating an account, or using the App, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Eligibility and Account Creation

  • Business Use Only: The App is designed for real estate professionals, including agents and brokers. It is not intended for consumers or individuals under the age of 18.

  • Account Security: To use the App, you must create an account with a valid email address and password. You are responsible for protecting your login credentials and for all activity that occurs under your account.

2. Services and AI-Generated Content

  • Service Description: Market It! allows users to upload real estate documents to extract insights and generate customized marketing kits, including MLS copy, social captions, flyer highlights, and short ad scripts.

  • AI Output Disclaimer: AI-generated content may be inaccurate, incomplete, or may not reflect current legal or regulatory requirements.

  • User Responsibility: You are solely responsible for reviewing, editing, and verifying all AI-generated content before publishing it on MLS platforms, social media, print materials, or any public channel.

3. Subscriptions and Billing

  • Subscription Requirement: An active, paid monthly subscription is required to access premium features, including document uploads and marketing kit generation.

  • Billing Platforms: Subscriptions are processed through Apple App Store or Google Play, depending on the device and platform. We do not collect or store your payment card details directly.

  • Auto-Renewal: Your subscription renews automatically each month unless cancelled through the App Store or Google Play store settings prior to renewal.

  • Cancellation and Refunds: You can manage or cancel subscriptions through the platform used for purchase. Refund requests are handled by Apple or Google and are subject to their policies.

4. User Content and Data Lifecycle

  • Ownership: You retain ownership of all documents you upload and the marketing content generated by the App.

  • License to Process: By uploading files, you grant us a temporary, limited, non-exclusive license to process those files solely to provide the App’s services.

  • Data Deletion: Uploaded files and generated marketing kits are deleted from our active systems thirty (30) days after creation, unless you remove them earlier.

5. Prohibited Conduct

You agree not to use the App to:

  • Upload content that you do not have the right or authorization to share.

  • Create fraudulent, deceptive, discriminatory, or unlawful marketing materials.

  • Violate local fair housing, advertising, or real estate regulations.

  • Reverse-engineer, tamper with, or interfere with the App’s service infrastructure.

6. Changes to the App and Terms

We may modify or discontinue the App, or update these Terms, at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

7. Termination

  • By You: You may stop using the App and delete your account at any time.

  • By Us: We may suspend or terminate your access immediately if you breach these Terms or misuse the App.

8. Limitation of Liability

To the extent permitted by law, Lucrative Software Solutions is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the App, including loss of business, data, or profits.

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which Lucrative Software Solutions is legally registered.
